AGREEMENT TO OUR LEGAL TERMS
We are Tampa Bay Drone Club ("Company," "we," "us," "our"), a local aeromodeling community registered in the state of florida, United States Of America.
We operate the website https://TampaBayDroneClub.com and (the "Site"), the meetup application group (the "App"), as well as any other related products and services that refer or link to these legal terms (the "Legal Terms") (collectively, the "Services").
These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and Tampa Bay Drone Club, concerning your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.
Supplemental terms and conditions or documents that may be posted on the Services from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Legal Terms from time to time. We will alert you about any changes by updating the "Last updated" date of these Legal Terms, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Legal Terms to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Legal Terms by your continued use of the Services after the date such revised Legal Terms are posted.
The Services are intended for users who are at least 13 years of age. All users who are minors in the jurisdiction in which they reside (generally under the age of 18) must have the permission of, and be directly supervised by, their parent or guardian to use the Services. If you are a minor, you must have your parent or guardian read and agree to these Legal Terms prior to you using the Services.

You may not access or use the Services for any purpose other than that for which we make the Services available. The Services may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.

Except as may be the result of standard search engine or Internet browser usage, use, launch, develop, or distribute any automated system, including without limitation, any spider, robot, cheat utility, scraper, or offline reader that accesses the Services, or use or launch any unauthorized script or other software.

Use a buying agent or purchasing agent to make purchases on the Services.

Make any unauthorized use of the Services, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretenses.

Use the Services as part of any effort to compete with us or otherwise use the Services and/or the Content for any revenue-generating endeavor or commercial enterprise.

Sell or otherwise transfer your profile.
USER GENERATED CONTENT
The Services may invite you to chat, contribute to, or participate in blogs, message boards, online forums, and other functionality, and may provide you with the opportunity to create, submit, post, display, transmit, perform, publish, distribute, or broadcast content and materials to us or on the Services, including but not limited to text, writings, video, audio, photographs, graphics, comments, suggestions, or personal information or other material (collectively, "Contributions"). Contributions may be viewable by other users of the Services and through third-party websites. As such, any Contributions you transmit may be treated as non-confidential and non-proprietary. When you create or make available any Contributions, you thereby represent and warrant that:

The creation, distribution, transmission, public display, or performance, and the accessing, downloading, or copying of your Contributions do not and will not infringe the proprietary rights, including but not limited to the copyright, patent, trademark, trade secret, or moral rights of any third party.

Your Contributions are not used to harass or threaten (in the legal sense of those terms) any other person and to promote violence against a specific person or class of people.

Your Contributions do not violate any applicable law, regulation, or rule.

Your Contributions do not violate the privacy or publicity rights of any third party.

Your Contributions do not violate any applicable law concerning child pornography, or otherwise intended to protect the health or well-being of minors.

Your Contributions do not include any offensive comments that are connected to race, national origin, gender, sexual preference, or physical handicap.

Your Contributions do not otherwise violate, or link to material that violates, any provision of these Legal Terms, or any applicable law or regulation.
Any use of the Services in violation of the foregoing violates these Legal Terms and may result in, among other things, termination or suspension of your rights to use the Services.
CONTRIBUTION LICENSE
By posting your Contributions to any part of the Services or making Contributions accessible to the Services by linking your account from the Services to any of your social networking accounts, you automatically grant, and you represent and warrant that you have the right to grant, to us an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, fully-paid, worldwide right, and license to host, use, copy, reproduce, disclose, sell, resell, publish, broadcast, retitle, archive, store, cache, publicly perform, publicly display, reformat, translate, transmit, excerpt (in whole or in part), and distribute such Contributions (including, without limitation, your image and voice) for any purpose, commercial, advertising, or otherwise, and to prepare derivative works of, or incorporate into other works, such Contributions, and grant and authorize sublicenses of the foregoing. The use and distribution may occur in any media formats and through any media channels.
This license will apply to any form, media, or technology now known or hereafter developed, and includes our use of your name, company name, and franchise name, as applicable, and any of the trademarks, service marks, trade names, logos, and personal and commercial images you provide. You waive all moral rights in your Contributions, and you warrant that moral rights have not otherwise been asserted in your Contributions.
We do not assert any ownership over your Contributions. You retain full ownership of all of your Contributions and any intellectual property rights or other proprietary rights associated with your Contributions. We are not liable for any statements or representations in your Contributions provided by you in any area on the Services. You are solely responsible for your Contributions to the Services and you expressly agree to exonerate us from any and all responsibility and to refrain from any legal action against us regarding your Contributions.
We have the right, in our sole and absolute discretion, (1) to edit, redact, or otherwise change any Contributions; (2) to re-categorize any Contributions to place them in more appropriate locations on the Services; and (3) to pre-screen or delete any Contributions at any time and for any reason, without notice. We have no obligation to monitor your Contributions.
SERVICES MANAGEMENT
We reserve the right, but not the obligation, to: (1) monitor the Services for violations of these Legal Terms; (2) take appropriate legal action against anyone who, in our sole discretion, violates the law or these Legal Terms, including without limitation, reporting such user to law enforcement authorities; (3) in our sole discretion and without limitation, refuse, restrict access to, limit the availability of, or disable (to the extent technologically feasible) any of your Contributions or any portion thereof; (4) in our sole discretion and without limitation, notice, or liability, to remove from the Services or otherwise disable all files and content that are excessive in size or are in any way burdensome to our systems; and (5) otherwise manage the Services in a manner designed to protect our rights and property and to facilitate the proper functioning of the Services.
INDEMNIFICATION
You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (1) your Contributions; (2) use of the Services; (3) breach of these Legal Terms; (4) any breach of your representations and warranties set forth in these Legal Terms; (5) your violation of the rights of a third party, including but not limited to intellectual property rights; or (6) any overt harmful act toward any other user of the Services with whom you connected via the Services. Notwithstanding the foregoing, we reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate, at your expense, with our defense of such claims. We will use reasonable efforts to notify you of any such claim, action, or proceeding which is subject to this indemnification upon becoming aware of it.
PAYMENT LINKS & SHARING OF OTHER APPS
You cannot share payment links of other services that collect member dues or payments from a URL link. Some of these services include but are not limited to: Paypal, Zelle, GoFundMe, And any other online merchant/fund raising platforms
Fundraising for the group is allowed under certain conditions provided that (a) The event organizer approves and knows about said fundraiser (b) provides for TBDC, its services and other areas where deemed appropriate. (c) Funds are used for further group meetups, for services on tampabaydroneclub.com or other functional areas within TBDC and its services.
CANCELLATION POLICY
Depending On Each Membership Level, a refund may not be applicable or applicable to the type of membership the account is enrolled in. Please see each section for details pertaining to each section:
Basic Membership Level & 90 Day Free Trial: This type of membership does not collect membership dues, in its nature it is also limited on membership benefits, and not all perks are included. Basic accounts are not eligible for any refunds including but not limited to: events, website purchase's, swag items, or other items not listed that are related to tampa bay drone club (TBDC). Any accounts inactive (we consider inactive not being active, RSVPING or showing up to events in 90 days inactive) will be deleted and remove from website. For Trial Accounts: account data will be deleted after 90 day trial period.
Pro Membership Level: Each membership account on the "services" including website, meetup, or other applications require a annual membership due(s). unless a fee was determined to not be charged, the "account" will be locked-in for a one-year (12) month membership by default. Membership accounts are not prorated. Each account shall choose to disable auto-renew on their service account or use in-person cash payment to avoid a auto-renewal charge every 12-Months. If acts, of god prevent us from hosting, promoting or running an event where dues were collected. TBDC is not under any obligation to refund collected dues, including event fees, member fees or other fees collecting before/during and after event(s). However, as a good faith we may choose to refund the payment methods using one of the means below; each "account" shall not be eligible for any monetary refunds if the membership account was cancelled after two (2) calendar days of account creation OR the date of the membership form was submitted whichever is sooner. For accounts where dues were not collected, no money shall be refunded at any time during the activated account. If a cancellation request was received by TBDC two (2) days post account activation, a full refund shall be provided to account holder in the most appropriate means of refund. this may include refunding using

All Paid Membership accounts that are marked as inactive or expired, will be deleted upon expiration, or renewal of membership.
ACTIVITY POLICY
For Each Membership Account, we, us "Tampa Bay Drone Club" and its services, requires that accounts be active and interact with the community in good-standing. Depending on the membership level, some additional perks may be included as part of benefits.
For Basic Accounts:
Membership account is required be active and log into website at-least once (1) every twenty-nine (29 days) or membership account will be considered INACTIVE. Failure to do any website activities including but not limited to: (a) rsvp to events, (b)log into membership account(s), (c) participate in the community on tampabaydroneclub.com will be marked as INACTIVE and subject to removal. For each inactivity period (30 days) a INACTIVE Strike will be marked on each membership account.. A Basic member may get no more than three (3) strikes before an account is deleted & de-activted on tampabaydroneclub.com
Additionally, a user will receive a email on the registered account for each one (1) offence if a user has not logged into our website or performed any activities including: (a) logging in to website (b) checking any website forums, such as groups or forums (c) any additional website activity when logged in.
We consider inactive accounts, accounts in which a user or pilot account fails to log into website or services in the required 29 days each time. For Each login, a new 29 days will start from the last date of login or website activity (whichever is the latest)
For Pro/Trial Accounts:
This Policy Does Not Apply To Trial Or PAID Or "Pro" Level membership's.
Accounts with Trial Or PRO May login when/how they want assuming they follow other policies in this document.
NO-SHOW POLICY
Each Membership Account is required to be active. Inactive accounts, will be deleted and its appropriate information deleted and removed from any services that tampa bay drone club is affiliated with runs, or advertises on. We consider inactive accounts, accounts in which a user or pilot account fails to log into website and (a) RSVP's but does not show up to event, or does not change RSVP prior to event date. (b) Is Under A Basic account designation and does not log into website or services in 90 days.
No shows (RSVP's but does not show to events) are not appreciated as the time to setup and schedule events. Any accounts that do not update their accounts prior to event time & date will be marked as a no-show, and may be subject to account termination without refunds. Only membership level (a) PRO or (2) Sponsorship) shall not be held no shows against their accounts.
Any account (a) Basic or free accounts (b) Trial accounts, that fail to change their RSVP and/or do not show up to event will be considered INACTIVE and are subject to one strike as a no-show. A user account may not get more then three (3) strikes with no show policy before account gets terminated, removed or deleted as determined by tampa bay drone club membership team. Any payments or fees collected will NOT be refunded if an account was deleted due to this no show policy. A User may not be permitted to re-join with a basic or trial membership period if the account was terminated under this policy.
SMS (TEXT) ALERTS
Each membership account on the "services" including website, meetup, or other applications. Will be auto-enrolled into SMS Texting Alerts. When provided a alert, the member may choose to un-subscribe to the automatic SMS Alerts, by replying back to the alerts. SMS Alerts are only to be sent out typically 1-2 per week (depending on storm events) and may not spam or reoccur during the same event day.
Note: when you reply back to stop alerts, you will no longer recieve SMS Text alerts about the following events:

Event Information (Event Reminders, Updates To Event, Cancellations)

TFR Alerts (FAA-Mandated No Fly Zones)

Weather-Related Events (such as hurricanes or impending storms)

Statewide alerts (Such as no fly zones initiated or otherwise)

*Note: SMS System is automatic and typically only sent out 1 or 2 times per day. We will never share your login or require you to login to a website. If you think the SMS is un-official, please visit our website at www.tampabaydroneclub.com/alerts. We will never ask for your login information or requiring you to login to a webpage besides our own website.
*Pilot is responsible for checking airspace prior to flight. Alerts Are provided as a convenience only, and may not to be used as a legal or survey grade limits. When in doubt, please visit the FAA Website at www.FAA.gov and check airspace prior to flight operations.
CBO (Community - Based - Organization's)
The FAA Currently Requires All Pilots To Fly With a CBO Safety Guidelines & Know Them By Hand. Tampa Bay Drone Club (TBDC) Requires that all pilots, regardless of their membership level follow at least one of the community guidelines:

Each pilot shall follow at-least one of the guidelines in addition to these terms set forth by tampa bay drone club. Failure to follow safety guidelines will be subject to account termination or account removal, and are subject to discretion by tampa bay drone club (TBDC). Pilot cannot hold TBDC Accountable for pilot choosing not to fly with or without safety guidelines.
PRIVACY POLICY
Protecting your private information is our top priority. This state of privacy applies to TampaBayDroneClub.com and governs data collection and usage. For the purposes of this Privacy policy, unless otherwise noted all references to Tampa Bay Drone Club include Tampa Drone Club.com. The TBDC website is a model aircraft / model aviation community site. By Using the TBDC website, you consent to practices described in this statement.

TBDC May disclose your personal information without notice if required to do so by law or in good faith belief that such action is necessary to protect it's members', organization or provide public safety.
RIGHT TO DELETION
Subject to certain exceptions' set our below, on receipt of a verifiable request from you, we will:
